This Privacy Policy explains how Grupo Fernández (“Grupo Fernández,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit https://grupofernandez.co, contact us, or communicate with us through WhatsApp and other Meta platforms. This policy is intended to meet Meta’s requirements for apps and WhatsApp Business Platform access, including transparency about messaging, consent, and data deletion.

2. Scope
This Privacy Policy applies to:
- Our website and contact forms
- Business communications by email, phone, or video call
- Communications and customer support via WhatsApp Business / the WhatsApp Business Platform (Cloud API or related Meta products)
- Any Meta/Facebook Developer apps we operate that connect to WhatsApp Business messaging for our company or our clients’ authorized business accounts
If we build or operate software for a client, that client may be an independent controller of their end-customer data. In those cases, our processing is governed by our agreement with the client and this policy describes how Grupo Fernández handles data in our role as service provider / processor, unless otherwise stated.
3. Information we collect
3.1 Information you provide
- Contact and inquiry data: name, email address, phone number, company name, project details, and any message you submit through our website forms or email
- WhatsApp messaging data: your WhatsApp phone number, display name, profile information visible to the business, message content you send us, media/attachments you share, and timestamps
- Business relationship data: contract details, billing contacts, support tickets, and preferences related to our services
3.2 Information collected automatically
- Device and browser type, approximate location derived from IP address, referring URL, and pages viewed
- Technical logs needed for security, debugging, and service reliability
3.3 Information from Meta / WhatsApp
When you message or interact with our WhatsApp Business account (or a WhatsApp Business account we manage for a client), Meta Platforms, Inc. and WhatsApp may provide us with identifiers and message metadata necessary to deliver, receive, and manage conversations through the WhatsApp Business Platform, such as WhatsApp phone numbers / WhatsApp IDs, conversation status, template delivery receipts, and related webhook events.
4. WhatsApp and Meta messaging
WhatsApp is a communication channel we use. We may use WhatsApp to respond to inquiries, provide customer support, send service-related updates, and—only where you have given valid opt-in—send permitted business or marketing messages.
4.1 Opt-in and consent
- We do not send WhatsApp marketing or promotional messages without your prior express opt-in consent that specifically names WhatsApp as the channel.
- Consent for email or SMS does not automatically authorize WhatsApp messaging.
- You may opt in by messaging us first, completing a form that clearly requests WhatsApp consent, confirming verbally/in writing during onboarding, or another affirmative action that records your agreement.
- You may opt out at any time by replying STOP, UNSUBSCRIBE, or an equivalent opt-out instruction, or by contacting us at info@grupofernandez.co.
4.2 Message types
- User-initiated conversations: if you message us on WhatsApp, we may reply within the applicable messaging window under WhatsApp/Meta policies.
- Service messages: transactional or support communications related to a request, project, appointment, or account.
- Template messages: where required by WhatsApp, we use approved message templates for notifications outside the customer-care window.
4.3 Meta’s role
WhatsApp and related Meta services are provided by Meta Platforms, Inc. (and affiliates). When you use WhatsApp, Meta also processes information under Meta’s and WhatsApp’s own terms and privacy policies. We receive and process WhatsApp business messaging data as needed to operate our business communications and, where applicable, client solutions. We do not sell WhatsApp conversation content.
5. How we use information
We use personal information to:
- Respond to inquiries and provide consultations
- Deliver, maintain, and improve our software and professional services
- Communicate with you by email, phone, or WhatsApp
- Authenticate conversations, prevent spam/abuse, and maintain security
- Comply with legal obligations and Meta/WhatsApp platform policies
- Analyze aggregate website usage to improve our site (where enabled)
We do not use WhatsApp message content to train public AI models, and we do not sell personal information.
6. Legal bases
Where applicable privacy laws require a legal basis, we rely on:
- Consent — for WhatsApp marketing/opt-in messaging and certain optional cookies
- Contract / pre-contract steps — to respond to requests and deliver services you ask for
- Legitimate interests — to secure our systems, improve services, and manage business relationships in a way that does not override your rights
- Legal obligation — where we must retain or disclose information to comply with law
7. How we share information
We may share personal information with:
- Meta Platforms / WhatsApp — as necessary to send and receive WhatsApp Business messages and operate Meta developer products
- Service providers — hosting, email, form processing (for example Google Forms when used on our site), cloud infrastructure, and support tools that process data on our instructions
- Professional advisors — lawyers, accountants, or insurers when needed
- Authorities — when required by law or to protect rights, safety, and security
- Clients — if you interact with a WhatsApp Business account or application we operate on a client’s behalf, relevant conversation data may be shared with that client as the business account owner
We require processors to protect personal information and use it only for contracted purposes.
8. Data retention
We retain personal information only as long as needed for the purposes described in this policy, including:
- Inquiry and sales records: typically up to 24 months after last contact, unless a longer period is needed for an active relationship
- WhatsApp conversation records: retained for support, audit, dispute resolution, and compliance, then deleted or anonymized when no longer needed
- Contract and billing records: retained for the life of the agreement and as required by applicable law
When retention ends, we delete or irreversibly anonymize the data, unless we must keep it for legal reasons.
9. Security
We use administrative, technical, and organizational measures appropriate to the risk, including access controls, encrypted transport (HTTPS), least-privilege access for staff, and vendor security review for tools that process personal data. No method of transmission or storage is completely secure; if we become aware of a breach affecting your personal data, we will take required notification steps under applicable law.
10. Your rights
Depending on your location, you may have the right to:
- Access the personal information we hold about you
- Correct inaccurate information
- Request deletion of your information
- Object to or restrict certain processing
- Withdraw consent (including WhatsApp opt-in) without affecting prior lawful processing
- Request a copy of your data in a portable format

11. Data deletion requests
In accordance with Meta Platform Terms and applicable privacy laws, you can request deletion of personal data we hold about you—including data obtained through WhatsApp Business messaging or Meta apps—by contacting us.
How to request deletion
- Email info@grupofernandez.co with subject “Data Deletion Request”.
- Include: your full name, WhatsApp phone number (with country code) and/or email used with us, and a brief description of the data you want deleted.
- We will confirm receipt, verify the request, and complete deletion (or explain any legally required retention) within 30 days, or sooner where required by law.
You will receive a confirmation email with a reference code you can use to check status by replying to that thread.
If you connected to a Meta app we operate and remove the app from your Facebook settings, follow Meta’s in-product deletion flow. You may also submit a deletion request to us using the instructions above. Where we have configured a Data Deletion Request callback in the Meta App Dashboard, that callback initiates the same deletion process and returns a status URL and confirmation code.
Note: Deleting data from Grupo Fernández systems does not delete your WhatsApp account or copies of messages stored on your device or by Meta/WhatsApp under their own policies.
12. Children’s privacy
Our website and services are directed to businesses and adults. We do not knowingly collect personal information from children under 13 (or the minimum age required in your jurisdiction). If you believe a child has provided us personal information, contact us and we will delete it promptly.
13. International transfers
We are based in Honduras and may process information in other countries where we or our providers operate (including the United States and other regions where Meta/WhatsApp and cloud providers host infrastructure). Where required, we use appropriate safeguards for cross-border transfers.
14. Cookies and analytics
Our website may use essential cookies needed for security and basic functionality. If we use analytics or advertising cookies, we will do so consistently with applicable consent requirements. You can control cookies through your browser settings. Third-party embeds on our site (for example Google Forms) may set their own cookies under their policies.
15. Changes to this policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top will change when we do. Material changes will be posted on this page. Continued use of our website or messaging channels after an update means you acknowledge the revised policy, except where consent is required by law.
